USER AGREEMENT – TERMS AND CONDITIONS

1. IN GENERAL

Access to and use of this Alston E Commerce Website and the products and services available through this Website are subject to the following terms and conditions. By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Website.

3. TERMS OF SALE

3.1. Alston, upon acceptance of an Order placed by its Customer, will supply the products and services specified in the Order to Customer, pursuant to the terms and conditions of this Agreement and its exhibits and Alston’s acceptance of such order submitted by Buyer is expressly limited to the terms and conditions of this Agreement notwithstanding any contrary provision contained by the Customer’s purchase orders, invoices, acknowledgements or other documents. The detail of the product, which is, quantity, price, product specifications, shall be set forth in the relevant Order.

3.2. You must be 18 year of age or over to place a valid order with Alston.

3.3. You must also possess a valid debit or credit card issued by a bank acceptable to us.

3.4. When placing an order you must undertake to ensure that all details you provide to us are true and accurate and that you are an authorized user of credit or debit card used to place your order.

3.5. Please be advised all prices advertised are subject to such changes.

4. OUR CONTRACT

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

5. PRICING

Alston endeavours to make all website pricing correct. In the event content on the website contains incorrect information, or a product is listed at an incorrect price, due to typographical errors or error in pricing information, Alston shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Alston shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

6. ITEM DESCRIPTIONS & DETAILS

Every care has been taken to ensure that the descriptions and specifications on this web site are correct. However, whilst every care is taken to ensure the colour reproduction is a reliable representation, the colours which are shown for the products on the website will depend on many factors – including your display settings. All sizes and measurements are approximate. All Goods are subject to availability – we may not be able to supply your order; we will often display more than one item in the product imagery. However, these are for display purposes only and, unless explicitly stated, are sold separately.

7. PAYMENT

Upon receiving an Order, we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will only be dispatched once the pre-authorization check has been complete. Your card will be debited once the order has been accepted.

8. DELIVERY

Dispatch times may vary according to availability and any guarantees or representations made as to the delivery times are limited to Sri Lanka and subject to any delays resulting from postal delays for which we will not be responsible for.

9. CHANGES

Alston shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

10. INDEMNITY

You hereby indemnify, Alston, and undertake to keep Alston, indemnified against any losses, damages, costs, liabilities and expenses including but not limited to legal expenses paid to any and all third party claims, liability, damages and/or costs arising from your use of the Website or our breach of the Terms & Conditions.

11. GOVERNING LAW & JURISDICTION

These terms and conditions are to be construed in accordance with the laws of Sri Lanka and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Courts of Sri Lanka.
